Banta, Director <br />Mined Land Reclamation Division <br />Department of Natural Resources <br />State of Colorado <br />423 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203-2273 <br />Dear Mr. Banta: <br />III IIIIIIIIIIIII III <br />999 <br />--, -~ <br />OCT D 5 1990 <br />l~iined Land <br />~~eCIa~T18flOn t)iVl$i~n <br />It has come to the attention of the City of Trinidad that Mr. <br />William Davis doing business as Rimrock Mining Company, is seeking a <br />permit from your agency for the development of and operation of a <br />coal strip mine southeast of this City. <br />From information obtained through Las Animas County, Trinidad has <br />become aware of Mr. Davis' submissions to your agency with regard to <br />the disposal of non-coal waste. Mr. Davis has apparently indicated <br />that waste material from his prospective mining operation is to be <br />disposed of at the landfill operated by the City of Trinidad. Please <br />be advised that no such arrangement has been made and without prior <br />agreement the City of Trinidad has no intention of accepting waste <br />material or other residuals from Mr. Davis' planned coal mining <br />operation. <br />Further, be aware that although a formal action adopting a position <br />statement has not been addressed by the Trinidad City Council, <br />nevertheless, the Trinidad City Council is concerned about the <br />potential environmental impacts that may occur should this mining <br />operation be authorized. <br />Your agency is asked to withhold any decision regarding Mr. Davis' <br />request for a mining permit, affording the City of Trinidad a chance <br />to formalize its position. <br />Your consideration on this matter is appreciated. <br />Sincerely, <br />Bill Cordova <br />City Manager <br />BC:ly <br />xc: Board of County Commissioners <br />Las Animas County Planning Commission <br />
