Dear Hr. Weaver;
Rules 2.07.6(2)(v) and 4.20.2 require that notice be provided to landowners who
own property above or adjacent to proposed mine workings. This notice is sent
to the property owners or residents at least six months prior to mining beneath
the property or residence. This notice is to include the specific areas in which
mining will take place, dates of mining activities that could cause subsidence
and affect specific structures, and measures to be taken to prevent or control
adverse surface effects. The Division located a letter you sent to the
landowners in August 1981; however, it only informs the owners of the reclamation
plan and not the mining plan.
in order to fully comply with the above referenced regulations, while after-the-
fact, a letter should be sent to the current landowners which describes the
mining activity at the O.C. ~2 Hine during operations. To assist you, I have
enclosed a draft of a letter which will meet the regulations. Please model your
letter, or use the letter I have enclosed to mail to John Walsh, Mac Stratman,
and Hildred Staples. Please provide verification to the Division that this
letter hoe been mailed to the three landowners.
