Box 2679 <br />Colorado Springs, Colorado 80901 <br />Re: Martinez Strip - File No. C-023-81 <br />Dear Mr. Drell: <br />The purpose of this letter is to convey to you certain preliminary con- <br />cerns which have been identified in the MLRD Review of your permit <br />revision request to mine the Barren Ridge area. This report constitutes <br />the 50-day notification of preliminary findings as to the substantive <br />adequacy of your application, pursuant to CRS 1973, 34-33-118(s), as <br />amended. I would like to stress the preliminary nature of this report, <br />as the review of your application cannot be completed without the benefit <br />of additional information. Additional comments may be forthcoming as our <br />review progresses on the issues raised in this preliminary report, and on <br />other issues as they arise. <br />All responses to deficiencies identified in eh is review, and any other <br />revisions or modifications you may wish to make to the application must <br />be submitted as revisions to the existing application. In order that the <br />final permit document will remain as comprehensive and concise as possible, <br />all revisions should be prepared in a manner that will facilitate their <br />insertion/substitution in the existing application; this must be done for <br />all six copies (MLRD-5, County Clerk-1). <br />Given the Division's concern with feasibility of mining, the Barren Ridge <br />area without permanently damaging the adjacent AVF, as well as the lack <br />of baseline environmental data outlined in the enclosed text, the Division <br />feels it may be difficult for Chimney kock Coal to gather the required <br />information and make the necessary demonstrations within the time frames <br />for review in the statute. If the information cannot be gathered and <br />incorporated into the application or necessary demonstratives made by the <br />120th day following the completeness determination, the Division will not <br />be able to make findings of compliance with the Act or recommend approval <br />for the application. <br />
