This mining plan approval document is issued by the United States of America
to:
West Elk Coal Company Inc.
P.O. Box 591
Somerset, Colorado 81434
for the Mt. Gunnison No. 1 mine subject to the following conditions. West Elk
Coal Company Inc. is hereinafter referred to as the lessee/operator.
Condition 1. Statutes and Regulations.--This mining plan approval is issued
pursuant to Federal coal leases C-1362, C-0117192, and D-044569;
the Mineral Leasing Act of 1920, as amended (30 U.S.C. 181 et
sec.); and in the case of acquired lands, the Mineral Leasing
Act for Acquired Lands of 1947, as amended (30 U.S.C. 351 et
s_g.). This mining plan approval is subject to all applicable
regulations of the Secretary of the Interior including, but not
limited to, 30 CFR Chapter VII and 43 CFR Group 3400, and to all
regulations of the Secretary of Energy, which are now or
hereafter in force; and all such regulations are made a part
hereof. The lessee/operator shall comply with the provisions of
the Water Pollution Control Act (33 U.S.C. 1151 et sec.), the
Clean Air Act (42 U.S.C. 7401 et sec.) and other applicable
Federal laws.
Condition 2. This document approves the Mt. Gunnison No. 1 mine mining plan,
updated through March 20, 1987, and authorizes coal development
or mining operations on Federal lands within the area of mining
plan approval. This authorization is not valid beyond
T13S, R90W:
Part of S1/2, Section 9; Wl/2W1/2 SWl/4, Section 15;
All of Sections 16, 20, and 21; E1/2 Section 19;
Part of NE1/4 of Section 30; Part of
N1/2 of Section 29; Part of Section 27, Part of
Section 28; and Part of NE1/4 of Section 34;
as shown on the map appended hereto as Attachment A.
Condition 3. The lessee/operator shall conduct coal development and mining
operations only as described in the complete permit application
package, updated to March 20, 1987, and approved by the Colorado
Mined Land Reclamation Division, except as otherwise directed in
the conditions added to this mining plan approval.
