c-. <br /> <br />III IIIIIIIIIIIIIIII <br />Mining Plan Approval Document No. CO-0021, October 1987 <br />Page 1 of 4 <br />UNITED STATES <br />DEPARTMENT OF THE INTERIOR <br />This mining plan approval document is issued by the United States of America <br />to: <br />West Elk Coal Company Inc. <br />P.O. Box 591 <br />Somerset, Colorado 81434 <br />for the Mt. Gunnison No. 1 mine subject to the following conditions. West Elk <br />Coal Company Inc. is hereinafter referred to as the lessee/operator. <br />Condition 1. Statutes and Regulations.--This mining plan approval is issued <br />pursuant to Federal coal leases C-1362, C-0117192, and D-044569; <br />the Mineral Leasing Act of 1920, as amended (30 U.S.C. 181 et <br />sec.); and in the case of acquired lands, the Mineral Leasing <br />Act for Acquired Lands of 1947, as amended (30 U.S.C. 351 et <br />s_g.). This mining plan approval is subject to all applicable <br />regulations of the Secretary of the Interior including, but not <br />limited to, 30 CFR Chapter VII and 43 CFR Group 3400, and to all <br />regulations of the Secretary of Energy, which are now or <br />hereafter in force; and all such regulations are made a part <br />hereof. The lessee/operator shall comply with the provisions of <br />the Water Pollution Control Act (33 U.S.C. 1151 et sec.), the <br />Clean Air Act (42 U.S.C. 7401 et sec.) and other applicable <br />Federal laws. <br />Condition 2. This document approves the Mt. Gunnison No. 1 mine mining plan, <br />updated through March 20, 1987, and authorizes coal development <br />or mining operations on Federal lands within the area of mining <br />plan approval. This authorization is not valid beyond <br />T13S, R90W: <br />Part of S1/2, Section 9; Wl/2W1/2 SWl/4, Section 15; <br />All of Sections 16, 20, and 21; E1/2 Section 19; <br />Part of NE1/4 of Section 30; Part of <br />N1/2 of Section 29; Part of Section 27, Part of <br />Section 28; and Part of NE1/4 of Section 34; <br />as shown on the map appended hereto as Attachment A. <br />Condition 3. The lessee/operator shall conduct coal development and mining <br />operations only as described in the complete permit application <br />package, updated to March 20, 1987, and approved by the Colorado <br />Mined Land Reclamation Division, except as otherwise directed in <br />the conditions added to this mining plan approval. <br />
