We <br />understand that the water supply for this operation will be hauled to the <br />site. We do not know the source of this water, but as long as the source is <br />decreed for and allows the proposed use, we do not object. <br />All surface water will be routed around the mined area and all precipitation <br />falling on the mined area will be released to the stream after passing through <br />sedimentation ponds. This is acceptable to us since all surface water will be <br />released without being used. Also, the mined area will not be deep enough to <br />expose the Trinidad Sandstone, thus, ground water should not be exposed to the <br />atmosphere. If ground water is exposed during mining operations, a well <br />permit and an augmentation or substitute supply plan will be required to <br />replace depletions to the affected stream systems. <br />A review of our records indicates that there is one decreed water right in <br />Section 29. This right is the Engle Pipeline. The Engle Pipeline was <br />conditionally decreed for 100 gpm in Case Number 6118-240, dated January 12, <br />1925. This right was also the subject of Case Number 84CW210 in which the <br />Engle Pipeline was deleted from the abandonment list. Our records also <br />indicate that there are two permitted wells located in Section 20, T33S, <br />R63W. These wells are associated with Permit Numbers 85157 and 92034. <br />We do not object to the issuance of this permit subject to the above <br />conditions.
