Savage <br />RE: Trinidad Basin Mine Right of Entry <br />I have reviewed the Trinidad Basin Mine (C-048-81) permit application with <br />respect to legal right to enter on the permit area; S 1/2, N 1/2 of <br />Section 15, S 1/2 of Section I5, and all of Section 22, T31S, R65W. Trinidad <br />Basin Mine bases their right to enter the permit area on two leases; one with <br />Alvin Wiggins (July 25, 1980), and one with Lilian Denison (the former <br />Mrs. Wiggins) on April 29, 1982. The legal descriptions of the entire western <br />portion of the Wiggins Ranch for which Trinidad Basin Mining has right to <br />enter are contained in part in the application. The portion of the Wiggins <br />Ranch description contained in the permit application does not cover the <br />entire permit area. I contacted the Las Animas County Clerk and Recorder for <br />the full description. Though they would not glue me the information over the <br />telephone, they are sending me a copy of the entire legal description for the <br />Wiggins Ranch. <br />In any event the leases are confusing and alternately refer to surface rights <br />(and properties) and mineral rights (and properties). <br />There is a possibility that Trinidad Basin Mine does not have legal right to <br />enter on portions of Sections 15 and 22, and that their legal right to enter <br />may have been misrepresented in the permit application. <br />/ep <br />Doc.
