D.C. 20240 <br />AFC ` B 1985 <br /> <br />,• <br />Memorandum / <br />~ _ Alti~..t.~ ~ 1G.~2`~ <br />To: Assistant Secretary for Land and Minerals Management <br />From:Q.oti Director, Office of Surface Mining Reclamation and Enf rcement <br />Subject: Recommendation for Approval of the Energy No. 1, Energy No. 2 and <br />Eckman Park Mines Mining Plan, as Modified, Colorado Yampa Coal <br />Compat~p, Routt County, Colorado, Federal Lease(s): C-22644, <br />C-20900, C-128433, C-081330, D-052547, C-16284 and C-26914 <br />I recommend approval of the Energy No. 1, Energy No. 2 and Eckman Park mines <br />mining plan, as mod ified,pursuant to the Mineral Leasing Act of 1920, as <br />amended. ~ recommendation to approve the Colorado Yampa Cosl Compatyy's <br />mining plan, as mod ified,is based on: (1) the company's complete permit <br />application paclrage (PAP) as submitted and updated through November 1, 1985, <br />(2) review of the PAP by the State as required by the Colorado State Program <br />and cooperative agreemen+., (3) review of the operation and reclamation plan <br />portion of the permit app~icaticn by the Office of Surface Mining Reclamation <br />and Enforcement, (4) the Federal lands review pursuant to section 522(b) of <br />the Surface Mining Control and Reclamation Act of 1977 (SMCRA), (5) comments <br />and recommendations or concurrence of other Federal agencies, including the <br />findings and recommendations of the Bureau of Land Management with respect to <br />the resource recovery and protection plan and other requirements of the lease <br />and the Mineral Leasing Act of 1920, as amended, (6) compliance with the <br />National Environmental Policy Act of 1969, and (7) documentation assuring <br />compliance xith applicable requirements of other Federal laws, regulations <br />and executive orders. <br />The Secretary may approve a mining plan, as modified, for Federal lands under <br />30 U.S.C. 207(c) and 1273(c). I find that the proposed operations will be in <br />compliance with all applicable laws and regulations, and I recommend the <br />Energy No. 1, Energy No. 2 and Eckman Park mines mining plan, as modified, <br />and updated through November 1, 1985, be approved. <br />The Energy No. 1, Energy No. 2 and Eckman Park mines mining plan approved on <br />March 24, 1980, along with this mining plan modification, is reflected in the <br />proposed mining plan approval document included with this memorandum. <br />Because the Secretary of the Interior and the State of Colorado have entered <br />into a cooperative agreement which provides for the delegation to the State <br />of the permitting responsibilities for operations on Federal lands pursuant <br />to Section 523 of SMCRA, the previously issued Federal permit will be <br />dissolved upon approval of this mining plan, as modified. <br />
