SNELTON, Director <br />April 23, 1987 <br />Mr. Terrell Johnson <br />Colorado Yampa Coal Company <br />29588 Routt County Road No. 27 <br />Oak Creek, Colorado 80467 <br />Re: Middle Creek Office Building Reclamation Plan, Colorado Yampa Coal <br />Mine No. 3, Permit No. C-81-036 <br />Dear Mr. Johnson: <br />The Division has considered your request to define the type of demonstration <br />which would be required to allow the Middle Creek office buidling to remain <br />as a permanent structure on the Middle Creek alluvial valley floor (AVF). <br />The Division has reviewed the Rules and Regulations that pertain to AVF's <br />and have concluded that Rule 2.06.8 and Rule 4.24 require the reestablishment <br />of the essential hydrologic functions of any alluvial valley floor after mining. <br />Anticipated changes to Rule 2.06.8 and current Office of Surface Mining <br />guidelines indicate that the essential hydrologic functions of all AVF's must <br />be reestablished at the conclusion of mining. <br />Demonstrations that the area of the affected AVF is small compared to the <br />total area of the AVF and demonstrations that the structure is beneficial to <br />farming are insufficient because they do not address the issue of reestablishment <br />of the essential hydrologic function of the AVF required by Rule 2.06.8 and 4.24. <br />Feel free to contact me if you have any questions regarding this matter. <br />Sincerely, <br />~~. <br />Brent C.
