Depi. cf tdatural Resources <br />This firm represents the Victor-American Fuel Company, <br />oc/ner of all coal except the NZ of the NE; in Section 15, <br />T31S, R65W of the 6th P.M., Las Animas County, Colorado. In <br />the course of litigation between Victor-American and Trinidad <br />Basin, we discovered that the referenced Mining Permit <br />erroneously includes within the permitted area a substantial <br />portion of our client's coal in Section 15, with respect to <br />which the permitee has no coal lease or other right of <br />entry. <br />We believe that the files of the Mined Land Reclamation <br />Division, which we recently reviewed, doucment this error <br />and shed some light on how it may have occurred. In support <br />of its application, Trinidad Basin Mining originally sub- <br />mitted an agreement dated July 25, 1980, which made reference <br />to leases granted by Victor-American. Apparently, Trinidad <br />Basin never supplied MLRD with copies of actual Victor- <br />American leases, but rather submitted copies of agreements <br />with the surface owners which referred to Victor-American <br />leases. In fact, the only Section 15 land ever leased by <br />Victor-American was the N; of the S;, and that lease had <br />expired at the end of a fixed five-year term prior to is- <br />suance of the referenced mining permit. <br />
