LochhpaA
Eaecunv¢ Direc'lor
M¢hael B. Long
Division D~reclur
The Division has transmitted the permit document for the Yoast Mine. As indicated in the
accompanying letter, the document must be signed by an officer of Seneca Coal Company to
acknowledge the stipulations and activate the permit. Due to the nature of the stipulations, the
Division wants to reiterate to Seneca Coal Company the conditions of this approval. These
conditions originated in correspondence dated June 7, 1995, from Larry Routten to Gary Wendt
and yourself.
Approval of the permit application is for the first five year mine plan only, and does not
constitute the Division's acceptance of mine plans for subsequent permit terms. Since the
Division and Seneca Coal Company have not agreed to predictions of the probable hydrologic
consequences in the Sage Creek basin, the Division has approved only mining disturbance which
will drain to Grassy Creek. In no way does this approval guarantee Seneca Coal Company the
right to mine beyond the first five year disturbance boundary, as shown on Exhibit 12-1, Sheets
1 and 2.
If you or your staff have questions or need additional information, please contact me.
Sincerely,
Ow~Lt ~~~i~l~-Prr
Susan L Burgmaiet
Environmental Protection Specialist

STATE OF COLORADO
sLn~ososvs.wP
