Gunnison No. 1 Mine as shown in Exhibit 3.1.1.D. <br />Drawing No. C-001, Page No. 1 are such that it will be necessary to <br />locate the proposed coal loadout, conveyor, and associated railroad <br />siding within 100 feet of the outside edge of the right of way of the <br />existing State Highway 133 (SH 133). Additionally, upon the Colorado <br />Department of Highway's (CDoH) completion of the relocation of SH 133 to <br />the south side of the North Fork in Section 9, T35W R90W, proposed <br />sediment control structures and the coal loadout conveyor and railroad <br />siding will be located within 100 feet of the then existing right of way <br />of tiie realigned SH 133. Pursuant to Section 34-33-114 (2) (g) (IV), <br />CRS of the Colorado Surface Coal Mining and Reclamation Act, CRS 1973, <br />34-33-101 et seq., and Section 522 (e) (4) of the Surface Mining Control <br />and Reclamation Act, PL 95-87, Atlantic Richfield is hereby requesting a <br />variance to allow construction of these facilities within 100 feet of <br />the outside edge of the existing and the to-be-constructed right of way <br />of the SH 133, a public road. Attached to this request fora variance <br />is a letter dated June 24, 1981, from Mr. R. Prosence, District Engineer, <br />CDoH granting their permission for Atlantic Richfield to locate these <br />facilities within 100 feet of the outside edge of the right of way of SH <br />133. This situation is not unique to the Mt. Gunnison No. 1 Mine. <br />Virtually every mining operation in the valley of the North Fork above <br />Paonia, Colorado has some portion of its surface facilities in close <br />proximity to SH 133. <br />Atlantic Richfield has worked closely with CDoH on the proposed re- <br />location of SH 133 in the vicinity of the Mt. Gunnison No. 1 Mine. CDoH <br />has held public hearings in Paonia, Colorado on the Draft EIS (November <br />2, 1977) and the Final EIS includes plans for the planned relocation of <br />SH 133. At the Informal Conference held May 12, 1981 in Paonia, Colorado, <br />to submit public input on the proposed Mt. Gunnison No. 1 Mine, na <br />mention of any concern with the location of surface facilities in relation <br />to the existing or proposed right of way of SH 133 was expressed or <br />implied. This is in light of the fact that Atlantic Richfield's permit <br />application for the Mt.
