Oept.of Natural Resources <br />Enclosed are five (5) copies of the mine plan and a narrative section from <br />the subsidence part of Powderhorn Coal Company's permit application containing <br />revisions requested by Jim Pendleton. <br />Jim Pendleton telephoned me on August 23, 1982, to inform me that he had re- <br />viewed the subsidence information submitted to the Division on August 11 as <br />part of Powderhorn Coal Company's formal response to the first draft of the <br />findings and proposed decision document. He indicated that Powderhorn's <br />response to the subsidence issues was satisfactory pending minor revisions <br />to the mine plan and the subsidence monitoring plan. <br />The first revision requested was to add the boundaries of the protected zone <br />along Rapid Creek and Cottonwood Creek to the mine plan of Exhibit 5. Mr. <br />Pendleton added that a minimum of 50 feet would probably be required as a <br />buffer to protect the alluvial deposits adjacent to some parts of Rapid Creek. <br />The second revision requested was to add a statement to the subsidence mon- <br />itoring section saying that the Division will make the determination of how <br />long beyond the cessation of mining monitoring must continue to determine <br />the magnitude and other critical aspects of subsidence. <br />Mr. Pendleton closed by saying he would be out of the office for two weeks <br />beginning August 30, and he would need a written committment that these <br />revisions would be made before Friday, August 27, in order that he could <br />complete his review and draft the findings before taking leave. I responded <br />with a letter dated August 26 stating that the specific revisions requested <br />would be made part of the Powderhorn permit application. <br />POWDERHORN COAL COMPANY P.O.
