I have enclosed a copy of the letter sent to the Chairman
of the Mined Land Reclamation Board requesting an informal alluvial
valley floor determination opinion pursuant to rule 2.06.8(3)(a)
contained in the Regulations of the Colorado Mined Land Reclamation
Board for Coal Mining. The request for the informal opinion is for
the Trinidad Basin Mining, Inc., mine located in Del Agua Canyon in
Las Animas county.
I am hopeful that the staff's investigation will be conducted
as soon as possible so that the Boards opinion can be used to aid
in the preparation of the permit application. I realize the
staffing problems you are now encountering and hope that this
request does not significantly add to those problems. As stated
in the letter to Joe, Trinidad Basin Dlining will be willing to supply
any information they have on hand to aid in your evaluation.
I could request that you give serious consideration to a joint
inspection of the site, as I do believe it could be beneficial
to both parties.
If you do decide to conduct a site investigation and invite
Trinidad Basin Mining representatives to accompany you, I could
appreciate it if you could provide the inspection date as soon as
possible. This will allow me time to coordinate the inspection
with all the different parties ~„orking on the permitting project.
