The referenced section reads as follows: <br />"The permittee shall submit a written request to the Colorado <br />Water Quality Control Division and the U.S. Environmental Pro- <br />tection Agency to deactivate a discharge point. The Division <br />will grant or deny the request in writing. The Division's <br />decision will be based on whether grading of the disturbed <br />area has been completed to return the earth to the desired <br />contour and reclamation work has begun. If the request to <br />deactivate is granted, the point in question shall not be <br />subject to any NPDES permit requirements." <br />Colorado Yampa Coal Company (CYCC) hereby requests that a total of eight dis- <br />charge points be deactivated. These discharge points no longer qualify as <br />"point sources," which drain from "active mining areas," as these terms are <br />defined in Part III, Section C of the Permit. Attached to this submittal are <br />Cliree exhibits, documenting that certain areas at Energy Mines 1, 2, and 3 <br />have been regraded to desired contour and reclamation work has begun. The <br />exhibits are described below. <br />Exhibit 1 is a mine inspection report from the Colorado Mined Land Reclamation <br />Division (C~II.RD), dated June 16, 1981. 1'he inspection report states on page 3 <br />that the final grading at the south end of Area 1, that portion of the mine <br />which drains to discharge point 009 was completed. Subsequently, reclamation <br />work including topsoil replacement and diversion ditch construction has been <br />conducted on the reclaimed surface. Therefore discharge point 009 qualifies <br />for deactivation. <br />
