The situation is complicated by the fact that the ponds will <br />eventually be reduced in size to less than 2 acre-feet by sediment influx. I <br />have briefly outlined the circumstance and have enclosed two maps of the <br />ponds, a general location map and a discussion of the proposed ponds. I would <br />appreciate the return of these items unless you feel if necessary to retain a <br />copy. <br />Colorado Yampa Coal Company is proposing 2 ponds as part of their sediment <br />control system for a proposed surface mining operation in Routt County. They <br />are also proposing to leave these ponds after reclamation as permanent stock <br />watering ponds. The ponds have emergency spillways but no permanent <br />dewatering devices. <br />The Energy Mine No. 3 pond is an existing pond with an area of 83.8 acre-feet <br />according to CYCC's calculations. They propose to fill this pond to a size of <br />21.3 acre-feet. They have calculated that in 13 years sediment influx wilt <br />have reduced the size to under 2 acre-feet. <br />The Middle Creek Mine Detention Basin is 5.7 acre-feet and is proposed for <br />construction. In order to meet our requirements this pond will have to be <br />slightly larger. Based upon the present proposed size, sediment influx will <br />have reduced the size to under 2 acre-feet in less than 10 years. For both <br />ponds it appears CYCC's volume calculations are in error and actual volumes <br />are somewhat smaller, but that should not affect the issue. <br />I need to know if permanent water storage rights are necessary for the interim <br />period; CYCC states in their application that they have substantial senior <br />surface water rights in the general area of the permit.
