COMMENTS:
Most of the Division's concerns had been dealt with through Peabody's responses;
the following items needed followup:
3. Rioht of Entrv
From an examination of the maps and text in the permit, HGTI appears
to have right of entry for all lands within the permit area.
11. Maos
A. The Division agrees with Peabody that it would serve no purpose to
show all wells, water conveyances, impoundments, etc for a one mile
radius from the permit area. However the Division has requested,
and the Peabody has agreed, to:
1. Label on Exhibit 4-1, those structures in question that
are in closest proximity to the permit area and moat
likely to be affected by the operation.
2. Reference, in Tab 7, that this information can be found
on Exhibit 4-1.
B. The Division can not read the listing of water rights given in
Attachment 14-1. Peabody agreed to resubmit this page.
12. Total Dissolved Solids
The Division has serious concerns about the adequacy of the current
monitoring system. I told Peabody that we were going to stipulate
the permit to resolve this issue by a given date. The Division's
concerns about the monitoring program are:
