The information which
was submitted with your request is sketchy and incomplete. Information which is lacking includes
such things as runoff and settling pond plans and locations, operation plans including schedule of
operation, haul route and where final load out to trains will be located, mitigation plans for habitat
loss, reclamation plans, etc. Due to the overall size of the proposed mine facilities this information
is essential in order to fully assess the overall wildlife impacts caused by the establishment of this
new mine. At this time we will give you our preliminary assessment of this proposal, as we
understand it, in regazd to impact to the wildlife resource. This assessment is made based on the
information available to us at this time. The assessment may change as further information becomes
available.
There are some inaccuracies in the Threatened And Endangered Species Survey report prepared by
Enviro25 Environmental Services Inc. The most obvious inaccuracy ir7 t,'te report states Lhat
wintering Bald Eagles are reported to be found along the North Fork River up to but not east of the
town of Paonia. In fact wintering Bald Eagles are found along the North Fork of the Gunnison river
up to Paonia Reservoir, along Muddy Creek to the base of McClure Pass and along Coal and
Anthracite creeks up to the Erickson Springs area. This includes the area of river valley adjacent to
the proposed mine facilities. While Bald Eagles are found in this area, we agree with Jerry Craig's
assessment that the establishment of this facility will have little or no affect on the three raptor
species surveyed.
DEPARTMENT OF NA]LRAL RESOURCES, lama 5 IacEheE, Eaxvorc Duna
W DDLD1 COMMISSION, Mmlb Lyvr, Cbai(WY • Rrbnu L.
