Gunnison No. 1 Mine. My <br />decision to aprove ARCO Coal Company's application for a permit <br />under the Federal Lands Program is based on the applicant's <br />complete permit application, public participation, and the review <br />and processing of the application by OSM and the Colorado Mined <br />Land Reclamation Division (MLRD), all as required by 30 CFR <br />Chapter VII, Subchapter D and the approved Colorado State <br />Program. <br />I adopt the Regional Director's recommended decision included in <br />the attached package as the findings required by 30 CFR 741.19. <br />Accordingly, I am prepared to issue the attached permit if your <br />decision on the plan is favorable. Issuance of the permit, <br />together with this memorandum and the contents of the attached <br />regional recommendation package, will constitute my final <br />decision under 30 CFR 741.21(a)(5). Under 30 CFR 787.11, my <br />final decision is appealable toy the Office of Hearings and <br />Appeals. <br />I recommend that the mining and reclamation plan be approved with <br />the stipulation that this approval will not take effect prior to <br />action by the Colorado Mine Land Reclamation Board at their <br />public hearing scheduled for July 23, 1981, and the Secretary has <br />had the opportunity to ascertain what changes, if any, are <br />necessary in this approval based on the Colorado Board action. <br />Attachments <br />I approve: <br />f• <br />
