Gunnison No. 1 Mine. My decision to aprove ARCO Coal Company's application for a permit under the Federal Lands Program is based on the applicant's complete permit application, public participation, and the review and processing of the application by OSM and the Colorado Mined Land Reclamation Division (MLRD), all as required by 30 CFR Chapter VII, Subchapter D and the approved Colorado State Program. I adopt the Regional Director's recommended decision included in the attached package as the findings required by 30 CFR 741.19. Accordingly, I am prepared to issue the attached permit if your decision on the plan is favorable. Issuance of the permit, together with this memorandum and the contents of the attached regional recommendation package, will constitute my final decision under 30 CFR 741.21(a)(5). Under 30 CFR 787.11, my final decision is appealable toy the Office of Hearings and Appeals. I recommend that the mining and reclamation plan be approved with the stipulation that this approval will not take effect prior to action by the Colorado Mine Land Reclamation Board at their public hearing scheduled for July 23, 1981, and the Secretary has had the opportunity to ascertain what changes, if any, are necessary in this approval based on the Colorado Board action.
