Discussion follows, by the number: <br />APPLICATION FORM <br />(1) The discrepancy between item 15 and 16 in the General Operation Infor- <br />mation on the Application can be explained as follows: As you are aware, BLUE <br />FT,AME COAL MINE ownes the coal in the exposed coal seam on a 40 acre tract. The <br />area affected, including the underground seam, bench areas and access roads, equal <br />approximately 25.1 acres, defined as the affected area. The bond and insurance <br />will cover the full 40 acres because BLUE FLAME COAL MINE has the right to use what- <br />ever surface that may became necessary for mining operations. As I understand, the <br />definition in 1.04.(7), affected area means the lands which are presently being used <br />or land that is located above or below the actual coal seam. The affected area de- <br />finition is in the present and past-tense. The definition of acreage to be permitted <br />as defined in Rule 1.04(89), includes all land indicated on the map in all araes which <br />are now presently or will be affected by coal mining. The definition has a future <br />et_ement in it and that is the reason that the full 40 acres were listed in the de- <br />finition of acreage to be permitted. However, BLUE FLAME COAL MINE has no objection <br />to amending either or both of the acreage areas. Please advise us as to your plea- <br />sure. P'_ease find enclosed a letter from MR. CARWIN R. BLEIIYP, regarding my author- <br />ization to bind this application. <br />2.03.3 FORMAT AND SUPPLEMENTAL INFORMATION <br />(2) All technical data and appropriate supplemental information was gathered <br />b y the acceptable standard methodologies of the discipline involved.
