We have evaluated the proposed modifications to the Federally-approved mine
plan for Che'Aoex Wo. 2 coal nine to determiine crirether the nropoeed action is
a ";wajur" modification. I have determined that the modifications proposed (1)
to construct a sett.lin¢ pond, (2) to ~:~nstncct additiona] sediment r_ontrol
facilities, (.3) to ins [all surface and ground water r;onitoriuy stations, (4)
co insr.all an adcii.tional mine fan at the Apex Vie. 1 portal and, (5) to remove.
material stored on. the south side of Tieut Creek, are minor modifications.
