Shelton <br />Director <br />September 3, 1982 <br />Mr. Joe Carpine <br />Twin Pines Coal Company <br />1780 Brookside <br />Canon City, Colorado 81212 <br />Re: Reclamation Responsibility at the Twin Pines Mine and Modification <br />of a Compliance Deadline. <br />Dear Mr. Carpine: <br />The Division would like to clarify .the reclamation responsibilities at <br />Twin Pines Atine now that the mine has been sold. In accordance with <br />Rule 2.08.6, the permit rights and responsibilities can be transferred <br />to the new owner. The proper form, for transferring the rights, which <br />you have received is the "Request for Transfer of Permit and Succession <br />of Operations.~~ <br />When this form is completed and submitted to the Division with a <br />replacement bond and surety agreement approved by the Division, the <br />permit is transferred. Until that time, the original operators are <br />responsible for reclamaCion~ on-site. You and Budgie Fazzino as <br />co-owners of Twin Pines and co-signers of the existing surety agreement <br />are still responsible for reclamation of the Twin Pines P1ine site. <br />The second topic of business of this letter, the compliance deadline, <br />ran now he resolved now that reclamation responsibility is clear. In <br />your letter of August 23, lUS2, you req~.iested an extention on the com- <br />pliance deadline for removing equipment from the area south of. the <br />tipple and north of the shop. The neca deadline for removing al.l debris <br />and equipment from the area south of the shop is nctober 1, loR2. The <br />equipment north of the shod need not he moved by this deadline if the <br />new operators confirm that this area will ,be within their proposed <br />permit area and that they assume reclamation responsibilities. If non- <br />firmation is not received by September 20, 1982, the Dctober 1, 1982, <br />deadline still exists. All seeding and/or reseeding of disturbed areas <br />must he completed by November 1, 1n82. <br />
