Garton: <br />The Division has reviewed the most recent pernit application for the He1e,~ mire <br />with the intention of writing the requiz~ed findings of compliance (encompassing <br />all aspects of the operation) which must be made prior to permit issuance. The <br />enclosed ma terials'represent the results of this review. The Division was able <br />to rra};e findings of,compliance in several areas. <br />Por most Copies thez'e are still deficiencies in the anplication which require <br />the submittal of additional inlormation, and musr_ be resolved in order for <br />the Division to wriCe findinys. I have indicated those findinys the Di vision <br />was able to make, as well as those deficiencies which need iv be resolved. <br />The timely approval of your mine plan and issuance of the permit will be directly <br />related to the adequacy and expediency of your reponses to the deficiencies. .111 <br />responses must be submitted to the Division in a form that can easily be in- <br />corporated into the existing permit application. <br />It is also important that all changes to the mine plan that have been submitted <br />foz' t.l-~e abatement action be incorporated into the permit application. This <br />includes changes to the permit boundary, sediment pond, permanent diversion and <br />coal processing plant.
