On July 23, 1983, I received your letter dated
July 18th with the Proposed Decision and Findings of Compliance
document which is dated July 13, 1983.
As I discussed by telephone with Dan Mathews on
July 19th and directly with you, Dan and Fred Banta on July
20th. I am extremely concerned over some statements in this
proposed decision and by the fact that Terror Creek was
unable to discuss these concerns more fully prior to the
reported notice of this decision published in the "North
Fork Times" on July 21 and 28.
Please accept this letter as Terror Creek Company's
formal letter of concern and request for certain modifications
in this proposed decision prior to its final approval by the
Division or the Board.
Our specific concerns and requests are as follows:
1. Stipulation No. 1 - page 3:
Concern: There is no legal authority for CMLRD to
require that a performance bond be posted with the Division
within certain specified days of "approval" of the permit
and proposed decision. As you well know, the law provides
