S , <br />Hal D Simpson <br />~u~'o~; Stale Engineer <br />This is in response to your letter of August 5, 1996, critiquing our comments in my letter <br />of March 13, 1996. <br />Item 2 refers to our comment regarding plugging drill holes penetrating unconfined <br />aquifers and your question if DMG rules are different than DWR's. In short, DWR's rules and <br />DMG's rules regarding plugging this type of drill hole are different. <br />Specifically, DMR's Rule 4.07 as cited in your letter states: <br />407.312) (in part) <br />"Exploration holes, drill holes or boreholes, wells, or other underground <br />openings completed in aquifers shall be sealed using cement or other <br />suitable sealant by placing the sealant in the hole from the bottom to <br />within 10 feet of the surface.° <br />While DWR's Water Well Rules and Regs specifically state: <br />"15.2 Unconfined Wells -Wells completed into unconfined aquifers shall be <br />plugged and sealed by filling with drill cuttings, clean sand or clean <br />gravel to the static water level, then with clean native clays, cement <br />or high solid bentonite grout to the ground surface. A permanent <br />watertight cover shall be installed at the top of the casing." <br />These differences are moot, however, if the drill hole is for prospecting or obtainino <br />minerals, in that Rule 3.2 of the Water Well Construction Rules specifically state: <br />"3.2 By statute these Rules do not apply to excavations made for the purpose <br />of obtaining or prospecting (emphasis added) for minerals .... as those <br />wells subject to the jurisdiction of the Mined Land Reclamation Board as <br />provided in Article 32 of Title 34 (Minerals) and Article 33 of Title 34 <br />(Coati, C.R.S. <br />
