This is in response to your letter of August 5, 1996, critiquing our comments in my letter
of March 13, 1996.
Item 2 refers to our comment regarding plugging drill holes penetrating unconfined
aquifers and your question if DMG rules are different than DWR's. In short, DWR's rules and
DMG's rules regarding plugging this type of drill hole are different.
Specifically, DMR's Rule 4.07 as cited in your letter states:
407.312) (in part)
"Exploration holes, drill holes or boreholes, wells, or other underground
openings completed in aquifers shall be sealed using cement or other
suitable sealant by placing the sealant in the hole from the bottom to
within 10 feet of the surface.°
While DWR's Water Well Rules and Regs specifically state:
"15.2 Unconfined Wells -Wells completed into unconfined aquifers shall be
plugged and sealed by filling with drill cuttings, clean sand or clean
gravel to the static water level, then with clean native clays, cement
or high solid bentonite grout to the ground surface. A permanent
watertight cover shall be installed at the top of the casing."
These differences are moot, however, if the drill hole is for prospecting or obtainino
minerals, in that Rule 3.2 of the Water Well Construction Rules specifically state:
"3.2 By statute these Rules do not apply to excavations made for the purpose
of obtaining or prospecting (emphasis added) for minerals .... as those
wells subject to the jurisdiction of the Mined Land Reclamation Board as
provided in Article 32 of Title 34 (Minerals) and Article 33 of Title 34
