Box 783 <br />Trinidad, Colorado 81082 <br />Dear Mr. Mills: <br />The Division has become increasingly concerned with the lack of response by <br />Trinidad Basin Mining to concerns raised by the Division in the review of your <br />permanent program permit application. With the exception of the one meeting <br />between representatives of TBM, Sutherland, Ricketts, and Rindahl, and Michael <br />Savage of the Division, no additional progress has been made by TBM toward <br />resolving outstanding concerns in the permit application. At this time over <br />180 days have passed since the complete application was submitted. If TBM <br />does not show further diligence in the resolution of outstanding issues and <br />obtaining permanent program approval the Division will be required to take <br />action which may result in cessation of mining operations. <br />Sincerely, <br />David C.
