Bear <br />Bear Coal Company <br />Somerset, Colorado 81439 <br />Re: Bear Coal Company, Preliminary Adequacy Review <br />Our File No. C-033-81 <br />Dear Mr. Bear: <br />The purpose of this letter is to convey the preliminary concerns which <br />have been identified in the review of the application referenced above. <br />This review constitutes the 60-day notification of preliminary findings <br />as to the substantive adequacy of your application, pursuant to CRS 1973, <br />34-33-118(5). Additional comments may be forthcoming as the review pro- <br />gresses on the issues raised in this letter and on others that may be <br />identified. <br />All responses to deficiencies in this review process should be presented <br />as revisions to the existing application, not as additional submissions. <br />In order that the final document will remain as comprehensive and concise <br />as possible, all revisions should be prepared in a manner that will <br />facilitate their insertion in the application to replace the revised <br />materials. <br />In order that we may have adequate time to review responses submitted by <br />Bear Coal Company and incorporate the results of this review into the <br />written findings which must be prepared as part of the decision process, <br />it is essential that Bear Coal Company respond as expeditiously as possible <br />to the concerns raised in this letter. <br />I suggest that representatives of Bear Coal Company schedule a meeting <br />with the Division to discuss the comments in this Letter.
