Cox ,~ <br />, / <br />J/l~"'Y <br />RE: Empire Energy Findings - Additions <br />As per your request, I have written the following paragraphs for inclusion <br />into the Empire Energy Eagle No. 5 and No. 9 Mine permit findings document. <br />Geoloav - Rule 2.04.6 <br />The applicant provided one analysis of the "P" seam roof, coal and floor <br />materials in the January 30, 1984 submittal. This single analysis is not <br />representative of all strata to be disturbed during the 5-year permit term <br />the Eagle No. 9 Mine. The Division has required a minimum of one core <br />analysis or channel sample per square mile of mine workings with a minimum <br />three samples distributed throughout the permit area if less than 3 square <br />miles. The Division has required this number of analyses to determine the <br />range and variability of the chemistries and physical properties of the <br />in <br />of <br />affected strata, the roof, the floor, the interburden (splits, stringer, and <br />spars within the coal), and the coal. Map IV-3, No. 9 Mine Plan, maps a <br />"possible rock split" line running through the mine plan area. Since this <br />rock split will have to be wasted in the coal processing waste pile and/or be <br />fractured and exposed in the mine, this strata may impact the chemistry of the <br />waste pile and/or the chemistry of mine waters. The rock split was not <br />analyzed for tts chemical and physical properties. The Division deems the <br />following stipulation necessary to find the applicant in compliance with Rule <br />2.04.6. <br />Stipulation: <br />EMPIRE ENERGY CORPORATION SHALL PERFORM COMPLETE CHEMICAL AND PHYSICAL <br />ANALYSES ON ROOF, FLOOR INTERBURDEN {ROCK SPLIT) AND COAL STRATA FROM A <br />MINIMUM OF TWO ADDITIONAL LOCATIONS IN THE EAGLE N0. 9 MINE'S PERMIT <br />AREA.
