Sie are is receipt of a letter <br />dated December 18, 1979 from from To:may Rays describing the present,road grade <br />and the compliaace problems the minor variation in grade has caused your company. <br />Our inspectors have been aware of the aaomalp in the grade of the road for some <br />time. <br />The Division does not consider the stenpoese of the road, as described in <br />Pfr. Raye'e December 1B letter to be an et'fviroameatal problem at this point in <br />time. The Division will sot issue further violations for the road grade pro- <br />vided that the axietiag road is not modified in any way and that there continua <br />to be no enviromnental problems reaultiag,from the road. Of course, the road <br />will be eub~ect to review end possible mddlfication along with tha entire mine <br />when the nev permit application ie submitted pursuant to the approved permanent <br />program.
