RE: Draft Findings. for Seneca II-W Mine - File No. C=057-82.
Dear Mr. Wainwright:
Enclosed is a copy of the "Proposed Decision and Findings of Compliance for
the Seneca II-W Mine." The Division is proposing to approve the application "
with stipulation. -
Pursuant to Rule 2.07.4.(2) (d), the proposed decision must be published in a
newspaper local to the operation once a week for two weeks. If no request for
- a formal hearing is received within the 30-day public comment period after the
first publication, the Division's decision will become final. "
Peabody may file the required performance bond of $2,646,300.00 anytime after
the proposed or final decision. However, the permit cannot be issued and
mining cannot"commence until the bond has.been submitted and approved.
