Box 20611 <br />Denver, Colorado 80220 <br />RE: Proposed Rimrock Strip Mine - Proximity of Raton Natural Gas Company <br />Gas Transmission Line. <br />Dear Mr. Davis: <br />In response to your letter dated September 17, 1988 regarding the Raton <br />Natural Gas Company transmission line ~rhich crosses your proposed permit area <br />for the Rimrock Strip Mine, the Division essentially agrees with your <br />interpretation of Rule 4.08.4(7)(b) of the Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining. Except where lesser distances can be <br />approved on the basis of additional information, any permit issued by the <br />Division would not allo~~r blasting within 500 feet of the gas line. In fact, <br />no permit would be issued for surface mining activities near this line unless <br />its depth of burial or other relevant considerations made it clear that there <br />was no significant potential for environmental harm or danger to the safety or <br />health of the public as required by Rule 2.07.7(3). <br />During earlier discussions in regard to the proximity of this line to your <br />proposed permit area, the Division was advised by you that the line could and <br />would be moved. Based on this assurance, the permit area proposed by you was <br />authorized by the Division for study under the Small Operator's Assistance <br />Program (SOAP). At this time, however, it would appear that little more than <br />your Phase Two area could be approved as a strip mine should the gas line not <br />be relocated. If that reduced area does not appear practical to you and you <br />fail to follow through on applying fora permit within one year of your <br />receipt of the study conducted under the Small Operator's Assistance Program, <br />you will become liable for the cost of that study according to Rule <br />2.09.8(1)(b). <br />If you have any further questions in regard to the above, please contact me. <br />Sincerely, <br />James C.
