I have also
discussed the response to Stipulation No. 1 with Roy Cox. We both find
the operator's response to Stipulation No. 1 to be satisfactory.
The operator's response to Stipulation No. 2 does not directly address
the stipulation, and it is uncertain whether the response is acceptaole.
The operator must clarity that water from the wash bay well would no
longer be discharged to the stream/alluvial aquifer system. This could
be accomplished by discontinuing use of water from the spoils aquifer, or
by returning the water to the spoils aquifer following its use.
This response shoo-ld be clarified as soon as possible. If you or the
operator have any questions, feel free to ask.
/tip
cc: Jim Pendleton
Roy Cox
Ed Bischoff
Doc.
