Box 27583, Terminal Annex <br />Denver, Colorado 80217 <br />Re: Northern Coal Company's Review Process <br />Dear Jerry: <br />As you know, the Mined Land Reclamation Division and the Office of Surface <br />Mining have been trying to develop a cooperative review process for the <br />Northern Meeker Area Mines. The problem in coordinating this review has <br />stemed from the issue as to whether an Environmental Impact Statement needs <br />to be written to meet NEPA compliance requirements. It is my understanding <br />that the Office of Surface Mining has formally initiated the Environmental <br />Impact Statement process thus triggering the time clocks. Now, the important <br />step that the Mined Land Reclamation Division, in cooperation with the <br />Office of Surface Mining, needs to take is to provide you with comments on <br />the technical adequacy of your permit application. A review schedule has been <br />set up by the two agencies to provide you with substantive comments by <br />mid-May. <br />I have discussed the MLR review process with members of your staff and the <br />Office of Surface Mining as it pertains to the requirement that MLR send <br />you a preliminary adequacy letter within 60 days. The general consensus has <br />been that, at this point, a preliminary adequacy letter would not contribute <br />significantly to moving this review along. Also, the Office of Surface Mining <br />has already addressed a number of preliminary concerns during their apparent <br />completeness review (ACR), similar to what we would address in a preliminary <br />adequacy letter. The more important Letter will be the cooperative review <br />letter we will send you in mid-May. <br />For this reason we will not send you a pre2imi.nary adequacy Ietter and instead <br />will accept the permit application as it stands today.
