Dear Mr: Housekeeper:
As specified over the telephone today MSHA is requiring you to install a third
portal for this mine to compliment the two existing portals. In order to do
this, you must modify this permit through a technical revision. Enclosed is
the application form that needs to be completed and submitted with the
technical revision request. In addition to this application form, you will
need to submit revised maps and text addressing this new portal: We will need
three copies of the entire revision application document.
Please refer to Rule 2.08.4(5)(b) of the regulations which addresses the
procedures and requirements fora technical revision. Please note that after
you have submitted your revision request and we have deemed it complete
(i:e.: there is sufficient information to allow us to review it), you will
need to publish one time in the Durango Herald. Please submit this proposed
public notice with your revision application.
As discussed, we are aware that this new portal is critical to your ability to
mine this site. Therefore, we will attempt to review the revision as quickly
as possible: Please note, however, that we may need to take the entire
allowable 60 days depending upon the complexity of your application and
demands from other coal mines.
