This mining plan approval document is issued by the United States of America
to:
Colorado Yampa Coal Company
29588 Routt County Road 1127
Oak Creek, Colorado 80467
for the Energy No. 1, Energy No. 2 and Eckman Park mines subject to the
following conditions. Colorado Yampa Coal Company is hereinafter referred to
as the lessee/operator.
Condition 1. Statutes and Regulations.--This mining plan approval is issued
pursuant to Federal coal leases C-22644, C-20900, C-128433,
C-081330, D-052547, C-16284 and C-26914; the Mineral Leasing Act
of 1920, as amended (30 U.S.C. 181 et sew.); and in the case of
acquired lands, the Mineral Leasing Act for Acquired Lands of
1947, as amended (30 U.S.C. 351 et sec.). This mining plan
approval is subject to all applicable regulations of the
Secretary of the Interior including, but not limited to, 30 CFR
• Chapter VII and 43 CFR Group 3400, and to all regulations of the
Secretary of Energy, which are now or hereafter in force; and
all such regulations are made a part hereof. The
lessee/operator shall comply with the provisions of the Water
Pollution Control Act (33 U.S.C. 1151 et sew.), the Clean Air
Act (42 U.S.C. 7401 et sec.) and other applicable Federal laws.
Condition 2. This document approves the Energy No. 1, Energy No. 2 and Eckman
Park mines mining plan, updated through November 1, 1985, and
authorizes coal development or mining operations on Federal
lands within the area of mining plan approval pursuant to a
valid permit issued by Colorado Mined Land Reclamation Division
(NERD). This authorization is not valid beyond
Township 5 North, Range 86 West, 6th Principal Meridian
Section 19: SE1/4, E1/2SW1/4, S1/2 NE1/4, SE1/4NW1/4, Portions of
W1/25W1/4, Portions of SW1/4NW1/4;
Section 20: SW1/4, W1/2SE1/4, SE1/4SE1/4, Portions of NE1/4SE1/4;
