This letter constitutes the sixty day notification of preliminary <br />findings as required in 2.07.4(1) of the Colorado Rules and Regulations. <br />The preliminary nature of the enclosed comments must be stressed at this <br />point. Additional information may be required from H-G Coal Company as the <br />review continues. <br />One particular concern raised relates to <br />to the loadout facility. It will be necessary to correct <br />this problem before final approval by the Division. <br />The Division's decision to approve, deny or modify the permit application <br />or to continue the review for another sixty days after the one hundred twenty <br />(120) day review period expires depends largely upon how rapidly H-G Coal <br />Company responds to this letter. It is unlikely that the Division will be <br />able to have sufficient time to complete the review by the one hundred <br />twentieth day if your responses are received after May 11, 1981. Please <br />submit information in a form consistent with the application so that pages <br />can be replaced, etc. I recommend that once you have examined our comments <br />we have a meeting to discuss the issues. <br />(cont'd) <br />
