Cottony <br /> Acting Division Director <br />Dear Mr. Goodsell: <br />The Division of Minerals and Geology (DMG) conducted an inspection of the Kuntz Resource Recovery and Land Development <br />Project site on June 27, 2002. Although the DMG makes a practice of sending a copy of inspection reports based on complaints <br />to the complainant(s), in this case mailing of these copies was overlooked. If this caused any inconvenience, please accept our <br />apologies. Infomtation regarding the attached inspection report and the complaint itself is contained below: <br />1. A copy of the attached report was forwarded to the Office of the State Engineer and to the Colorado Department <br />of Public Health and [he Environment. Presumably the issues raised in the initial complaint letter will be <br />addressed by these two entities. <br />2. The inspection conducted by the DMG was performed in light of the Construction Rules and Regulations and <br />mining laws set forth by the State of Colorado and as to whether any violations to those rules, or the law, had <br />occurred. <br />3. The basis of the complaint appears to deal more directly with water rights and with issues handled by the Office <br />of the State Engineer, rather than with issues enforced by the DMG. <br />4. It has come to the attention of the DMG that there are data and records supporting the initial complaint which <br />were not considered at the time of the inspection. The original written complaints did not indicate that such <br />data existed, and if any of the complainants wish to forward this information to the DMG for review, the DMG <br />will review the information and forward it to [he proper office(s) if it does not directly apply to rules, <br />regulations, or laws enforced by the DMG. You will be notified of any material which is forwarded and to <br />whom. ' <br />Evidence from the site inspection, the nature of the complaint, and recent precipitation levels indicate at this time that [he problems <br />experienced in the vicinity of the Kuntz Resource Recovery and Land Development Project are likely drought-related and do not <br />fall under the jurisdiction of the DMG.
