To go <br />back to the beginning of the permit process, this took place in 1977 afrer H.B. 1065 was passed by <br />the Colorado Legislature. Operators were tinder pressure to get permitted and a lot of the <br />applications submitted at that time were rather vague, including this one. <br />The reclamation plan submitted needs to be discussed to clarify some of the misunderstandings that <br />have developed over the years. Afrer Berhan Keffelew's inspection of December 9, 1997, the issue <br />of highwalls arose. He understands from Mc Joe R~elte, President of Summit Brick, that in final <br />reclamation a benched highwall could possibly be left. You explained the BLM's position that you <br />do not like highwalls. I have discussed this v`~th Mr. Welte, you, and Berhan, and I believe that we <br />have a common understanding and agreement on the final reclamation plan. Sumarit plans to mine <br />out the balance of the hill. The overburden will be pushed over into the excavated azea as backfill. <br />The overburden is rather heavy, but the quality of tiie clay makes i[ worthwhile. This way there will <br />be nothing left to make a highwall. <br />The area will be seeded with the SCS recommended ntix. You specifically requested that the road <br />on the north side be ripped and re-seeded as part of the final reclamation plan. This was, and is <br />Summit's plan, and they do commit to doing this. The access road is on the ranch o«ner's property, <br />and they want i[ lefr to get into their pasture. <br /> <br />
