X303) 874-7561 <br />Nine i303) 856-6402 <br />In reference to letter dated April 24, 1979, I would like to direct <br />my comments on the violations of Permit #77-232. <br />2. The office and access road were cited along with an incoming <br />fresh water line which supplies our entire supply of fresh water. <br />A. Prior to Grand Mesa Coal's acquisition of Beldon Enterprises <br />in September, 1978, the office trailer was a private resi- <br />dence and the access road had already been cut. <br />B. The city water line from the Colby water district was also <br />in place, but was dug up and replaced because of numerous <br />breaks from the severe winter. <br />C. The refuse disposal area remains as it was prior to Grand <br />Mesa's takeover. <br />II. The total affected area is vertually as it was prior to September, <br />1978, however we have graded some roadways to facilitate drainage. <br />We feel the affected area to be slightly over 10 acres. <br />I2I. Other than our new vent shaft very little soil has been set aside <br />by the previous owners. We have, however, set aside 500 yard of <br />topsoil from another operation. The soil will be hauled from <br />Delta, Colorado, on a haulback from our coal trucks and set aside <br />for future reclamation. <br />While it is unfortunate that the problems cited in your letter do <br />exist, we plan on making improvements acceptable and comply with the law. <br />Sincerely yours, <br />PEM:cmm <br />GRAND MESA COAL COMPANY <br />~~~~~~ <br />Paul E.
