Dept. of Natural Resoerce~ <br />Denver, CO 80203 <br />Re: Cotter Corporation - Schwartzwalder Minla <br />File No. 77-300 <br />Dear Mr. Shelton: <br />This letter confirms several of the understa:~dings <br />reached during our conference yesterday with respect tl~ the <br />Notice of Inspection and Inspection Report issued by t:ze <br />Division pertaining to the referenced Permit. <br />1. Cotter will prepare and file applicatio~ls for <br />technical revisions and amendments to the permit, reflecting <br />current operational practices at the mine and licensin~3 <br />actions by other agencies which have occurred since the <br />issuance of the original f7ined Land Reclamation Permit. In <br />addition, the revisions and amendments will reflect cu:crent <br />plans for operations contemplated in the future. <br />2. Cotter is not now using the temporary w+~ste <br />pile to which reference is made in the Notice of Inspection. <br />The material from the pile which reached Ralston Creek, <br />approximately two cubic yards, has been retrieved. Thl~ pile <br />and all other storage and disposal facilities at the mine <br />have been and will continue to be subject to weekly in:apec- <br />tions. An analysis of the stability of the pile is be:Lng <br />undertaken at this time and the results will be includl=_d in <br />the application for amendment, or prior to that time, :Lf <br />available. <br />3. Cotter is not currently using the grave:L <br />(borrow) pit to which reference is made in the Notice cif <br />Inspection. No utilization will be made of that facil:Lty <br />until the amendment process is complete. <br />
