Reference: Response To "Problem Noted" Contained In Inspection Report from
OMLR Dated October ]2. 1994 -Stabilization of Soil Stockpile.
Dear Mr. Keffelew:
This letter responds, as has been requested by your Office, to the "Problem Noted" contained
in the Office of Mined Land Reclamation ("OMLR") inspection report dated October 12, 1994.
In that inspection report, which was received by the Cripple Creek & Victor Gold Mining
Company ("CC&V") on or about October 18, 1994, it is noted that the soil stockpile located on
the southeast side of permit area needed to be better controlled.
This letter is to notify you that the sediment controls have been established farther down the
valley to contain the growing stockpile. It is my understanding that the OMLR inspector present
on October 22 and 23 had no problem with the in-place controls.
For clarification, the OMLR inspection report was the result of a CC&V-instigated review of
conditions at the main soil stockpile. CC&V asked the inspector present on October 12th to
accompany CC&V to check on the status of improvements to the sediment control at the soil
stockpile in question -improvements that CC&V had requested through Bateman Engineers some
days earlier. Upon finding that all controls requested by CC&V were not yet in place, CC&V
directed Bateman Engineers, while still at the site and while still with the inspector, to improve
the sediment control, which Bateman had Ames Construction do the next day (October 13,
1994). To the best of our knowledge, the inspector agreed with the remedies -which were not
the same as presented in the October 12, 1994 Inspection Report.
The CC&V-specified remedies were to fortify the straw bale containments in the ephemeral
channel. The upstream bales have been overridden because of the growth of the stockpile. Re-
emplacement of certain of these bales would not have been as effective as the downstream
