It is my understanding that the OMLR inspector present <br />on October 22 and 23 had no problem with the in-place controls. <br />For clarification, the OMLR inspection report was the result of a CC&V-instigated review of <br />conditions at the main soil stockpile. CC&V asked the inspector present on October 12th to <br />accompany CC&V to check on the status of improvements to the sediment control at the soil <br />stockpile in question -improvements that CC&V had requested through Bateman Engineers some <br />days earlier. Upon finding that all controls requested by CC&V were not yet in place, CC&V <br />directed Bateman Engineers, while still at the site and while still with the inspector, to improve <br />the sediment control, which Bateman had Ames Construction do the next day (October 13, <br />1994). To the best of our knowledge, the inspector agreed with the remedies -which were not <br />the same as presented in the October 12, 1994 Inspection Report. <br />The CC&V-specified remedies were to fortify the straw bale containments in the ephemeral <br />channel. The upstream bales have been overridden because of the growth of the stockpile. Re- <br />emplacement of certain of these bales would not have been as effective as the downstream <br />
