Lochhcad
E%eCUlive Director
Michael B. Long
OiviSion Director
On 12/19/96, the Colorado Division of Minerals and Geology (DMG) inspected the
Soderquist Pit, located at your ranch property on Cimarron road. DMG and its Board,
Colorado Mined Land Reclamation Board, is responsible for inspections and enforcement
of State reclamation statutes. The inspection was a routine monitoring inspection, as
conducted on all permitted sites. Please find enclosed, copy of the inspection report
resulting from the 12/19/96 inspection.
The operator has indicated that you do not wish mining operations to continue at the
Soderquist Pit. The operator has also submitted copy of a note from Taurara Scheer,
stating that the landowners are satisfied with existing conditions. Copy of the note from
Taurara Scheer is included with the 12/19/96 inspection report.
State reclamation statutes require an operator to reclaim mining disturbances to a
beneficial land use. The existing reclamation plan for the Soderquist Pit includes
backfilling and grading slopes to no steeper than a 3H:1 V configuration, topsoil
replacement, and establishing a diverse vegetative cover capable of self regeneration.
DMG cannot terminate the Soderquist permit until the operator has satisfied all conditions
of the reclamation plan, in accordance with reclamation statutes. However, the statutes
allow alternatives to standard permit termination procedures, where operators have been
denied access for reclamation purposes.
Please clarify, in writing, whether the operator, Montrose County, has been denied access
to the Soderquist Pit for reclamation purposes.
~nrce~ery,
I~ ~ ~~?~-
Wallace H. Erickson
Environmental Protection Specialist
cc: Timothy L. Roberts, Montrose County
