Long <br />OiviSion Director <br />On 12/19/96, the Colorado Division of Minerals and Geology (DMG) inspected the <br />Soderquist Pit, located at your ranch property on Cimarron road. DMG and its Board, <br />Colorado Mined Land Reclamation Board, is responsible for inspections and enforcement <br />of State reclamation statutes. The inspection was a routine monitoring inspection, as <br />conducted on all permitted sites. Please find enclosed, copy of the inspection report <br />resulting from the 12/19/96 inspection. <br />The operator has indicated that you do not wish mining operations to continue at the <br />Soderquist Pit. The operator has also submitted copy of a note from Taurara Scheer, <br />stating that the landowners are satisfied with existing conditions. Copy of the note from <br />Taurara Scheer is included with the 12/19/96 inspection report. <br />State reclamation statutes require an operator to reclaim mining disturbances to a <br />beneficial land use. The existing reclamation plan for the Soderquist Pit includes <br />backfilling and grading slopes to no steeper than a 3H:1 V configuration, topsoil <br />replacement, and establishing a diverse vegetative cover capable of self regeneration. <br />DMG cannot terminate the Soderquist permit until the operator has satisfied all conditions <br />of the reclamation plan, in accordance with reclamation statutes. However, the statutes <br />allow alternatives to standard permit termination procedures, where operators have been <br />denied access for reclamation purposes. <br />Please clarify, in writing, whether the operator, Montrose County, has been denied access <br />to the Soderquist Pit for reclamation purposes. <br />~nrce~ery, <br />I~ ~ ~~?~- <br />Wallace H.
