August 1, 1994
Mr. Carl ES. Mount
Division of Minerals
1313 Sherman Street,
Denver, CO 80203
and Geology
Room 215
RE: Coal Creek Resource
Dear Mr. Pfount,
iii iiiiiiiiiii iii

AUG G ~- 1,994
^: r
We have learned that reclamation has begun on part of this project,
located ict the bottom of Coal Creek on state-owned land in Arapahoe
County. Native grasses have been drill seeded and the site has been
mulched with cereal straw.
It has beean reported to us that grass seedlings are developing despite
the hot, ciry conditions we've experienced this season. We are pleased
with the establishment success to date, but would like to point out a
serious omission in the implementation: fencing for livestock
exclusion..
Cattle are: already grazing the new grass seedlings--and the volunteer
barley from the mulch, which was obviously not "weed- and seed-free,"
as is usually specified. If there is to be any hope of building on
this early revegetation success, cattle must be excluded! It will
take at leaast two full growing seasons before native grasses will have
developed, physiologically and morphologically, to the point where
limited g7~azing can be conducted. This is recognized by state law in
Section 34-32-116 (n) of the Colorado Mined Land Reclamation Act:
ND grazing shall be perndtted on reclaiteed lam
1mti1 the planting is firmly established. 'ILe board,
in eaostrltatien rrith the landow»er and the local soil
omservation district. if may, shall detennirw rrhm
glazing tmy start.
We urge you to take appropriate action to see that livestock are
excluded 1°rom this site.
Please, dill us if you have any questions.
Sincerely,
Rosemary(A~cneill, President
Board of tlupervisors
cc: Mr. Gary Tuttle, Tuttle, Applegate Rindahl, Inc.
CONSERVATION - DEVELOPMENT ~ SELF-GOVERNMENT
~ oy~
Wact Ara~na Snil C:nns
~ 655 Partet Street, Room E300 - Lakewood, CO 80215-5517 - (303) 236-2702
