Prior to and since the inception of Senate Bill 120 in 1990, we <br /> have been working closely with the State Engineer's Office to keep all of our sites in compliance <br /> with these regulations. We are not aware of any problems with the water rights or with the well <br /> permit. <br /> I have discussed this issue with Dick Wolfe, State Engineers Office, and clarified a few issues with <br /> him. The statement you made, "Western Mobile has not perfected their well permit", is incorrect. <br /> Mr. Wolfe's commented that if Western Mobile owns this property, we need to transfer the permit <br /> into our name. Western Mobile does not own this property. Western Mobile took over operating <br /> this pit in 1989, but the property is still owned by Flatiron Sand and Gravel Company. When we <br /> applied for the well permit, it was recorded under Flatiron's name because they own the property. <br /> As for the issue with the water rights, Western Mobile is not listed on the water agreement <br /> because we do not own the property. This agreement is between Flatiron and District 6 Water <br /> Users Association because ultimately Flatiron will be responsible for the property once mining and <br /> reclamation are completed. <br /> In the future, could you please discuss these issues more fully with the appropriate agencies, as it <br /> can create a misconception of how we do business.
