The problems should be corrected by the <br />dates given, or they will become possible violations. The possible violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land <br />Reclamation Board. The inspector noted on the previous page should be notified of all <br />corrective actions taken. <br />PROHLSDt3/POSSIHLS VIOLATIONS <br />AND <br />CORRBCTIVH ACTIONS <br />DATE <br />1. PROBLEM: <br />The permit boundary markers installed by the operator do not PB or PV:PS <br />refl_e_ct the approve permit area of 3 acres in-size.__ -- TOPIC(S):MP <br />--- - - ~ 11/30/04 <br />CORRBCTIVE ACTION: <br />Amend the 110(2) permit application to properly reflect the <br />permit area of 3.8 acres. Currently, the markers delineate the <br />permit area to be 3.8 acres rather than the approved 3.0 acres. <br />Such amendment must be received by the Division on or before <br />November 30, 2004. <br />PROBLEM: PB or PV:PH <br />The reclamation plan does not address reclamation of the TOPIC(S):SF <br />maintenance building. - <br />il/30/04 <br />CORRECTIVE ACTION: <br />Address the reclamation of the maintenance building in the <br />amendment application so that the Division can calculate a cost <br />to remove the structure. if the building is to remain as a <br />component of the poetmining land use,(rtKen'a"- oval mua e <br />documented by the local land use authority by November 30, 2004. <br />'F-----~._ _______ ._ _. __-_--- <br />PROHLEM: <br />The mining and reclamation plan does not address the waste pile <br />created by the operator. <br />CORRECTIVS ACTION: <br />Address the creation and reclamation of the waste pile noted on <br />site. If the pile is to remain in place, the operator will need to <br />address reclamation of the cut slope in the channel to ultimately <br />achieve a 3h:ly slope. If this issue is not addressed by the <br />operator, then the Division will revise the reclamation cost <br />estimate to move the pile back to the cut slopes to achieve a 3h:ly <br />slope as so noted in the reclamation plan. This should be <br />submitted with item #I noted above. <br />PROBLEM: <br />The operator is utilizing water in the creek for the mining <br />operation, but has not submitted the appropriate documentation <br />to the Division. <br />PB or PV:PS <br />TOPIC(S):PW <br />11/30 04 <br />PB or PV:PH <br />TOPIC(S):HH <br />11/30/04 <br />CORRECTIVE ACTION: <br />Demonstrate that the operator is in compliance with the permit <br />and applicable Colorado Water Lawa regarding the use and <br />exposure of water in the Cashe Creek by November 30, 2004. <br />
