The Division understands that by supplying photographs of the new boundary <br />markers and mine identification signs, the operator is indicating compliance <br />with the corrective action specified in Notice of Violation M-93-016, Cease <br />and Desist Order, and order to pay civil penalties issued by the Board <br />following its meeting on this issue on May 27, 1993. <br />The Division accepts the photographs as the evidence of the instAllation <br />required by the Cease and Desist Order and considers that the required civil <br />penalty for Violation M-93-016 is $500.00, payable by July 8, 1993. <br />2. The Division does not recognize, among the materials submitted, the accurate <br />map of the permit area required as a corrective action for Problem 2 <br />identified during the April 1, 1993 inspection. <br />The date specified for that corrective action was June 1, 1993. Unless the <br />required map is promptly provided, the Division will have to consider the <br />problem as a possible violation and must proceed accordingly. <br />3. The Division recognizes that the Technical Revision submitted as part of the <br />materials supplied does include a proposal to add a concrete fuel containment <br />structure to the facilities approved for the operation. <br />The Division considers that the required corrective action for Problem 3 <br />identified during the April 1, 1993 inspection has been taken. The operator <br />should be aware, however, the problem continues to exist until the revision is <br />approved and the agreed additional bond is supplied. <br />4. The Division has determined during its brief inspection of the operation on <br />May 19, 1993 that the San Miguel River had been returned to its original <br />channel which is the corrective action required for Problem 4 identified <br />during the Division's April 1, 1993 inspection. <br />5. The Division recognizes that the Technical Revision submitted as part of the <br />materials received by the Division on June 2, 1993 contains a proposal to <br />include a statement in the permit application that mining at the site may <br />occur for less than 180 days per year., <br />This element of the proposed technical revision received by the Division on <br />June 2, 1993 is accepted by the Division as completion of the corrective <br />action required for Problem 5 identified during the Division's April 1, 1993 <br />inspection. <br />
