This permit covers a placer mine near the town of Fairplay. The Division last inspected the mine in May of 1993. There had been no activity at the site until we took over in April 1995, From April through July of 1995 we worked on establishing a new wash plant in the mine and generally cleaning up the mess that M & M Mining left behind. On or about August 1st the mine went back into production. We mined for only 60 days, since we had contracted to build a landfill in Weld County during the fall and winter of 1995-96. During those 60 days Zigan Sand & Gravel, Inc. merely made deeper the excavation that M & M Mining had begun. We did not enlarge the area of excavation, On Sept. 28, 1995, our last day of production for 1995, Gary Curtiss of the Division made an inspection of the site. This inspection was undertaken because of an adjacent property owner complaint about engine noise. On December 12, 1995 the Division mailed the inspection report to Zigan Sand & Gravel, Inc.. We received it on December 15, 1995, note, it took 11 weeks from the date of the inspection until we received the report. I have two great difficulties with this report. One: It is based on faulty observations and two: The time given for corrective action is seven days from the date received. I will comment on each of the problems /possible violations contained in the report.
