Enforcement <br />action forthcoming. <br />OBSERVATIONS OF Ti~ORTANCE: <br />Z. The mining operation is still ongoing and active. There are extensive stockpiles of <br />pit run and processed material in the pit. <br />2. The 60'-70' highwalls are still in place and seen to be actively being mined to the east. <br />3. Some backfilling to a height of perhaps 25' has occurred in one portion of the north <br />pit wall. However, most highwalls have not been reduced at all. <br />4. Until the pit is no longer being used for stockpiling, it is difficult to see how <br />backfilling can occur, and it is not evident that material for backfilling is being stored <br />in the pit. <br />5. Some topsoil has been stockpiled above the pit, but it has not been planted. Zt may <br />or may not be enough to do reclamation. Some of it seems quite close to the active pit <br />hi ghcva 11 s . <br />6. The existing $2,500.00 bond would not be adequate to do the extensive reclamation needed. <br />RECQ~$1ENDATIONS <br />1. The operator should clarify his timetable for backfilling aya inst the highwalls. 7b <br />date, this procedure has not occurred as he has stated it would. Be should also do a rough <br />calculation of his needs for backfill for the entire pit and of his sources in order to <br />make sure there will be enough material. The previous calculation did not give this entire <br />balance. This calculation should be submitted to our Division by the date given above. <br />Zn this regard, cohere will backfill material be stockpiled until used? <br />2. The operator should make sure that he has enough topsoil for. reclamation purposes and <br />that it is stockpiled well back from the highwalls. The topsoil should be stabilized with <br />a perennial grass cover crop as soon as possible. Please clarify the plans in this regard <br />by the date given above. <br />3.
