Cattany <br />, Division Director <br />// Natural Resource Trustee <br />RE: Mountain View Pit, Permit No. M-1981-002, Inspection Report Response Letter Dated 12/9/2005 / <br />Dear Mr. Bell: <br />Thank you for the response to the Division of Minerals and Geology's report of the Mountain View Pit inspection <br />conducted on October 6, 2005. Just to clarify, DMG listed the two items of concern as problems, not possible <br />violations. These items will only become possible violations if they continue to be inadequately addressed. <br />Problem 1. Weed infestation has been noted in several past inspection reports and continues to be a problem. For this <br />reason, DMG is now requiring that a weed control plan be submitted as a technical revision to the permit. Upon DMG <br />approval of the revision, adherence to the weed control plan will be a requirement of the permit, and documentation of <br />annual weed control efforts should be reported in the annual report to DMG. The fee for a technical revision is <br />$188.00 and must be submitted with the revision request. Please contact Ms. Adena Green at the Gunnison Basin <br />Weed Commission for information and help on drafting a site specific weed control plan. <br />Problem 2. Advancement of highwall erosion toward the southwest permit boundary has also been noted as a potential <br />problem in previous inspection reports. A plan of action appeared to be agreed upon, but submittal of supporting <br />documentation and on-the-ground corrections didn't occur. The eroding highwall has now reached the permit <br />boundary and threatens to cause off-site damage if not promptly stabilized. The previous plan to push the ridge of <br />native material above the highwall into the pit, thereby reducing the height and slope of the highwall is still acceptable <br />to DMG. Documentation of CDOT approval of this use of material and excavation activity on their right-of--way must <br />be submitted, as well as a request for technical revision to the permit that documents the proposed highwall <br />stabilization plan. The plan must demonstrate how the proposed action will stabilize the highwall, or include <br />additional provisions to ensure stability of the highwall is achieved. The plan may be combined with the weed control <br />plan and submitted as one revision.
