Long <br />Division Direnor <br />RE: Pit No. 1 ,Permit No. M-1 977-020, April 26`h response to March 30`" Inspection Report <br />Dear Mr. Johnson: <br />The Division of Minerals and Geology (DMG) has reviewed the document described above and has <br />the following comments listed with the same numbering as that document. <br />1. -2. Thank you for your quick response in moving the smaller fuel tanks into a containment <br />structure. Because of the proximity of the pumped down water table to the pit floor, the <br />crusher facility tank must immediately be placed on a liner within an adequately sized spill <br />containment structure. The structure can be of temporary design for now, but must be <br />lined. The technical revision due May 15"' may address long term spill containment <br />structure design and construction specifics. <br />3. The Heatec double compartment double walled tanks may be acceptable as double <br />containment if the valuing along the bottom of the tanks, for draining them, have some <br />type of secondary containment or at least are lockable and have adequate protective <br />features to prevent them from being struck and broken off. Any empty tanks on site do <br />not need to be placed in spill containment or removed from site until they are to be filled. <br />These tanks and any new tanks may not be filled until they are in adequate spill <br />containment structures. Design and construction of these spill containment structures was <br />to be addressed in a technical revision application due April 30, 2001. Compliance with <br />this corrective action did not occur by the correction date. To avoid a potential <br />enforcement action this problem must be addressed in a technical revision application due <br />May 15, 2001 . <br />Other Problems <br />A. Problem No. 3. -Thank you for initiating resolution of this problem promptly after the <br />inspection. Please submit photographic evidence of nesting box installation by May 15, <br />2001. <br />B. Problem No. 4. -Thank you for initiating resolution of this problem promptly after the <br />inspection. Please submit photographic evidence of completed revegetation measures by <br />May 15, 2001 . <br />
