i
' • • III IIIIIIIIIIIII III
March 9, 199f3
Re: Summit Hricl: and Tile Co.
Heaver Creek Clay Mine
MLkH Permit #m-77-322
HLM Contract No. CO-45C>-MS-98-02
Mr. Charlie Fair
Hureau of Land Management
koyal Gorge kesource Area
3174 East Main Street
Canon City, Colorado 81212
Dear Charlie
D~~.
~~
I have reviewed this file and thinl: we should lool; at where
we stand. November 3rd, 1997 Summit e;:ecuted a "Contract for
the Sale of Unit of Materials" Number Cp-U50-MS-98-42 with
your office, (A copy is attached) Exhibit H. Special
5tipulations~ Heaver Creel; Clay Mine was a part of that
contract. This basically is the PLM reclamation plan for the
site agreed to by both your office and Summit.
These are the same stipulations that have been a part of this
ongoing project since 1980. On page 2 of HerF~an l:efall.ew's
1nSppCt26n report, he quotes Joe Welte as saying that they
(the operator - Summit)_ might bench the highwall at some
height during final reclamation after consulting with HLM. It
appears that he remembered the Special Cariditions, as item
(j) Mined area will 6e terraced at intervals of from 10-12
feet down the slope. Terrace width wi7.1 be equal. to blade
width, and not less than 10 foot terraces will 6e inclined 1
to 2 inches toward cut slope.
Since this has been e;:ecuted as part of the program since
1984, it is my thought that perhaps we should stay with it.
Herhan F;:efallew said the MLkE would agree to this.
Let me know what you thin4:.
cord
lloydvbuck:
c~:a
cc:summit
geddes
