November 3rd, 1997 Summit e;:ecuted a "Contract for <br />the Sale of Unit of Materials" Number Cp-U50-MS-98-42 with <br />your office, (A copy is attached) Exhibit H. Special <br />5tipulations~ Heaver Creel; Clay Mine was a part of that <br />contract. This basically is the PLM reclamation plan for the <br />site agreed to by both your office and Summit. <br />These are the same stipulations that have been a part of this <br />ongoing project since 1980. On page 2 of HerF~an l:efall.ew's <br />1nSppCt26n report, he quotes Joe Welte as saying that they <br />(the operator - Summit)_ might bench the highwall at some <br />height during final reclamation after consulting with HLM. It <br />appears that he remembered the Special Cariditions, as item <br />(j) Mined area will 6e terraced at intervals of from 10-12 <br />feet down the slope.
